1. 생성형 AI 서비스 안내

BAEKIT의 제작 기능은 생성형 인공지능을 사용합니다. 결과는 실제 사실·사건·인물의 기록이 아니며, 오류·편향·유사한 결과나 예상하지 못한 표현이 포함될 수 있습니다. 제공되는 모델과 입력 방식에 따라 가능한 기능이 다릅니다.

제작을 시작하기 전에 이 약관에 명시적으로 동의해야 합니다. 자동화·외부 API·MCP를 통한 제작에도 같은 조건이 적용됩니다. 결과를 게시·광고·판매하기 전에 사실관계, 품질, 권리 및 해당 매체의 AI 표시 의무를 확인해 주세요.

2. 입력 자료와 인물·음성 이용 권한

직접 제작했거나 적법한 이용허락을 받은 프롬프트, 이미지, 영상, 음악, 음성 및 문서만 입력하세요. 이용허락은 AI 처리·변형·합성 및 예정된 공개·상업적 이용을 포함해야 합니다. 단순히 인터넷에서 구할 수 있다는 이유만으로 권한이 확보되지는 않습니다.

실제 인물의 얼굴·신체·음성·이름을 사용하는 경우 초상권, 인격권, 개인정보와 관련된 권한 및 필요한 본인 동의를 확보해야 합니다. 미성년자에 대해서는 필요한 법정대리인 동의도 확보해야 합니다. 비동의 성적 합성물, 아동 성착취물, 신원 사칭·금융 사기 또는 명예훼손 목적의 제작은 금지합니다.

주민등록번호, 신분증 사본, 계정 비밀번호·비밀키, 결제카드 정보, 건강·생체 식별 등 민감정보와 업무상 비밀을 입력하지 마세요. 타인의 개인정보를 처리하는 경우 이용자가 적법한 처리 근거를 확보해야 하며, 본 약관 동의가 그 사람의 동의를 대신하지 않습니다.

3. 요청 처리와 외부 AI 서비스

요청을 실행하면 해당 기능의 프롬프트·참조 미디어·설정이 서비스가 연결한 처리업체로 전달됩니다. 모델 개발사와 실제 API 처리업체는 다를 수 있습니다. 처리업체와 국외 처리에 관한 공개 자료는 개인정보처리방침에서 확인할 수 있습니다.

회사는 요청 처리, 결과 저장·전송, 장애 대응에 필요한 범위의 비독점적 이용허락만 받습니다. 비공개 입력·결과를 회사의 홍보나 자체 모델 학습에 사용하는 권리는 이 약관으로 받지 않으며, 그러한 별도 이용은 필요한 법적 근거와 별도 선택 절차를 마련한 경우에만 진행합니다.

외부 제공자의 안전성 검사·보안 로그·보관 조건은 제공자와 사용 기능에 따라 다릅니다. 학습에 사용하지 않는다는 정책이 무보관이나 즉시 삭제를 뜻하지 않습니다. 일반 약관 동의는 개인정보의 별도 제3자 제공·국외 이전 동의를 대체하지 않습니다.

4. 결과의 권리와 사용 범위

입력 자료에 대한 기존 권리는 권리자에게 남습니다. 생성 결과에 대한 권리의 발생과 귀속은 인간의 창작적 기여, 적용 법령과 모델별 이용 조건에 따라 달라집니다. 회사는 모든 결과의 저작권 성립, 독점성, 비침해 또는 무제한 상업 이용을 보장하지 않습니다.

선택한 모델의 이용 조건과 제3자의 저작권·상표권·초상권을 준수해야 합니다. 유료 플랜 결제가 제3자의 권리를 자동으로 허락하거나 별도 모델 라이선스의 제한을 없애지는 않습니다. 광고·판매·납품 전에 필요한 검수와 권리 확인을 수행해 주세요.

현실과 혼동할 수 있는 합성 이미지·영상·음성은 시청자가 AI 제작 또는 편집 사실을 알 수 있도록 설명·라벨 등 적절한 방식으로 표시하고, 서비스가 제공하는 출처·안전 표시를 기만 목적으로 제거하지 마세요. 서비스 화면의 AI 안내만으로 외부 배포물의 모든 표시 의무가 충족되지는 않습니다.

5. 실행, BP 사용과 취소

실행 버튼을 누르거나 승인된 API·MCP 클라이언트에 제작을 요청하면 유료 작업이 시작될 수 있습니다. 모델, 길이, 해상도, 결과 수와 단계별 실행 횟수에 따라 BP가 사용됩니다. 자동화는 여러 유료 요청을 수행할 수 있으므로 제시된 견적과 실행 범위를 검토하세요.

공급 개시 전 고지와 명시적 실행은 필요한 범위에서 기록됩니다. 이미 제공된 부분에 대한 청약철회 제한은 법정 요건을 충족한 경우에만 적용하며, 공급되지 않은 부분·하자·계약과 다른 이행에 대한 법정 권리는 유지됩니다. 취소·환불정책의 장애 보상 및 미사용분 처리 기준을 따릅니다.

6. 선택적 갤러리 공개와 재사용

갤러리 공개는 선택 사항입니다. 게시 확인을 하면 작품, 표시 이름, 공개 제목·설명이 불특정 다수에게 노출됩니다. 프롬프트는 별도로 공개를 선택한 사본만 노출됩니다. 공개 입력란에는 연락처나 비밀정보를 쓰지 마세요.

게시자는 갤러리 제공을 위해 작품의 표시·전송·미리보기 생성에 필요한 비독점적 이용을 회사에 허락하고, 다른 이용자가 서비스의 다운로드·프로젝트 가져오기 기능으로 사본을 저장하고 창작 참고·편집에 사용하는 것을 허락합니다. 이 허락은 제3자의 권리를 넘어서지 않으며, 별도 허락 없는 원본의 재판매·권리자 사칭·인물의 보증이나 추천을 암시하는 광고 이용은 허용하지 않습니다.

게시 중단·삭제는 고객지원에 요청할 수 있습니다. 게시를 중단해도 이미 제3자가 저장한 사본이나 검색엔진 캐시를 완전히 회수할 수는 없습니다. 회사가 갤러리 운영을 넘어 외부 광고에 작품을 사용하려면 별도 허락을 받아야 합니다.

7. 금지 행위, 신고와 이의제기

위법 콘텐츠, 비동의 성적 합성, 아동 착취, 타인의 권리 침해, 사칭·기만, 위협·괴롭힘, 불법 개인정보 수집, 보안 침해 및 제공자의 안전장치 우회를 금지합니다. 회사는 신고·법령상 요청·확인된 위험에 따라 해당 콘텐츠의 생성·공개나 계정 이용을 필요한 범위에서 제한할 수 있습니다.

권리 침해 신고와 제한에 대한 이의제기는 premia.art@gmail.com으로 대상 URL 또는 작업 식별자, 사유, 본인의 권한을 설명하여 접수할 수 있습니다. 민감한 신분증 원문은 사전 요청 없이 보내지 마세요. 회사는 가능한 범위에서 사유와 처리 결과를 안내하고 정당한 이의를 재검토합니다.

본 약관은 회사의 고의·중과실 책임이나 법이 보장하는 소비자 권리를 배제하지 않습니다.

1. Generative AI notice

Creation uses generative AI. Outputs are not records of real facts, events or people and may contain inaccuracies, bias or similarities to other work. Explicit acceptance is required before creation, including through automation, API and MCP. Review accuracy, rights and applicable AI disclosure requirements before publication.

2. Input, likeness and voice rights

Only submit materials you own or are authorized to use for AI processing, alteration and the intended publication or commercial use. Public availability does not establish permission. Obtain necessary permissions for real people’s likeness, identity or voice, including guardian permission where needed.

Do not create non-consensual sexual content, child sexual exploitation material, impersonation for fraud or defamatory content. Do not input identity documents, government IDs, passwords, secret keys, card details, sensitive health or biometric identifiers, or confidential information. Your acceptance does not replace another person’s consent or a lawful basis for processing their data.

3. Processing and external AI services

Running a request sends the relevant prompts, references and settings to the connected processors described in the Privacy Policy. The API processor can differ from the model developer. You grant only the non-exclusive permission needed to process, store and deliver requests and resolve failures.

These terms do not grant BAEKIT permission to use private content for its advertising or its own model training. Such uses require a separate lawful basis and choice. Provider safety checks, security logs and retention vary. A no-training policy does not mean zero retention. These terms do not substitute for separately required data-sharing or international-transfer consent.

4. Output and commercial use

Existing input rights remain with their owners. Output rights depend on human creative contribution, applicable law and model terms. We do not guarantee copyright protection, exclusivity, non-infringement or unrestricted commercial use. Paid access does not license third-party rights. Review model licenses and clear necessary rights before publishing, advertising or delivering work.

Use suitable labels or explanations to disclose AI generation or alteration where required, particularly for realistic synthetic images, video or voice. Do not remove origin or safety labels to mislead. An in-app notice alone does not satisfy every obligation for externally distributed content.

5. Execution, BP and cancellation

An explicit Run action or a request from an authorized API/MCP client can start paid work. BP depend on model, duration, resolution, output count and execution steps. Automation can submit multiple paid requests; review estimates and scope first. Restrictions on withdrawal apply only to supplied portions where statutory requirements are met. Rights for undelivered, defective or non-conforming services remain under the Refund Policy and applicable law.

6. Optional publication and reuse

Gallery publication is optional and exposes the work, display name, public title and caption to the public. Only an explicitly selected prompt copy is public. Do not include private contact details or secrets.

Publication grants BAEKIT non-exclusive permission to display, transmit and preview the work for Gallery operation and permits users to download or import copies for creative reference and editing. This cannot license third-party rights. Reselling the original, falsely claiming authorship or using a person’s identity to imply endorsement is not permitted without further permission. External advertising by BAEKIT requires separate authorization.

Contact support to unpublish or remove work. Copies previously saved by others or search-engine caches may remain after removal.

7. Restrictions, reports and appeals

Unlawful, exploitative, non-consensual sexual, infringing, fraudulent, harassing or security-abusive uses and bypassing safeguards are prohibited. We may restrict affected content or accounts as needed in response to reports, legal requests or verified risks.

Send reports or appeals to premia.art@gmail.com with the work URL or job identifier, reason and evidence of authority. Do not send unrequested identity documents. We provide reasons and review justified appeals where practicable. These terms do not exclude mandatory consumer rights or liability for intentional or grossly negligent conduct.
